The brother of the former Braden River High School football coach charged with DUI manslaughter has been ordered by a judge to give a video recorded deposition about who was driving the truck that flipped several times.

Apparently, the man initially said his brother (the defendant) was the one driving the Ford pickup truck at the time of the deadly wreck. However, at a court date last week he told the circuit judge handling the case he refuses to testify against his brother. Instead the judge ordered him to be deposed on video today 4-27-10. The deposition took place at 9 am today at the state attorney’s office in Sarasota.
The man could face jail time for contempt if he continues refusing to testify. He probably will to because prosecutors are relying solely on his statement because the other survivor of the crash said he doesn’t remember who was driving (smart thinking!)
