Tampa Man Charged With DUI on Bicycle

A Tampa man riding a bicycle was charged with driving under the influence after Collier County stopped him in East Naples.

The sheriff’s office reports that 51-year-old Tommy Charles Miller was riding a bike Saturday night without any lights. When deputies stopped him, they reported that his eyes appeared bloodshot, and he smelled like alcohol. Deputies also found two cans of beer in the bike’s front basket.

Miller was arrested and charged with DUI, refusing to submit to a DUI test, having an open alcohol container in public and refusing to sign a citation. He was being held on $7,000 bail.

Tampa Man Charged With DUI After Trolley Crash

A Tampa man was charged with driving under the influence after reportedly crashing into a trolley.

Tampa police say the 34-year-old male was driving on the trolley tracks Saturday night when he ran his sport utility vehicle into an oncoming trolley.

Officers reported the DUI suspect recorded a blood-alcohol level of 0.217 and 0.214 percent. State law considers a person impaired at 0.08. He was arrested and charged with suspicion of DUI and failure to drive on a designated roadway. He was released Sunday on $500 bail.

The trolley was carrying four passengers and the operator, but no injuries were reported. Little damage was done to the trolley, and it was working again a short time later.

FHP Arrests 537 in Holiday DUI Sweep

TALLAHASSEE, Fla. –  The Florida Highway Patrol arrested 537 motorists for driving under the influence during a 19-day holiday crackdown.

The Dec. 16 to Jan. 3 stretch of heightened enforcement throughout Florida also included 16,213 speeding tickets and 4,531 tickets to drivers for not wearing their seat belts.

During the “Drunk Driving, Over the Limit, Under Arrest” campaign, the highway patrol increased troopers’ patrols and added reservists and auxiliary troops.

A good percentage of this group of 537 will be convicted of DUI, be forced to pay hefty fines and have their licenses taken away. However, with the help of the Sarasota DUI attorneys here at Musca law many of them would be able be freed of a drunk driving conviction.

Former Braden River Coach’s Trial Set

SARASOTA — Former Braden River High School football coach Josh Hunter will stand trial this spring on a charge of DUI manslaughter, a judge ruled Thursday.

Florida Highway Patrol troopers say Hunter, 31, was drunk when he crashed his truck on March 21, 2009 near Nokomis, killing his best friend Doug Garrity. Hunter’s attorney, Brett McIntosh, said authorities claim his client’s blood alcohol level was 0.21 after the crash. The legal limit in Florida is .08.

Hunter appeared before Circuit Judge Donna Berlin for a case management hearing at the Sarasota County courthouse.

After a private discussion with the judge and prosecutors, Berlin set Hunter’s trial for April 19.

“There is a great deal of work to be done on both sides of the case,” Berlin said at the conclusion of the brief hearing.

Hunter was reportedly driving his Ford truck in south Sarasota County when it flipped on an Interstate 75 on-ramp. Garrity, a football assistant coach, died when he was ejected from a back seat.

Hunter and the other passengers in the truck, his brother, James Hunter and Matthew Braselton, were not injured.

According to reports, after the crash Trooper George Yock said Hunter had a “strong odor of alcohol about his person and watery, bloodshot eyes.”

Also at the scene, troopers photographed an open Michelob Ultra Beer bottle inside the truck and “numerous Michelob Ultra beer bottles and cans” near the truck where it came to a stop after it overturned.

James Hunter and Braselton wrote in statements to investigators that Hunter was driving home to Bradenton and veered off the road to avoid striking a deer.

No sobriety tests were given at the scene and no arrest was made. But FHP troopers drew Hunter’s blood and sent it to a lab for drug and alcohol testing.

A DUI manslaughter arrest warrant for Hunter was issued in October. He turned himself in, was arrested and posted bond.

Hunter faces up to 15 years in prison if convicted of DUI manslaughter.

A state champion during his playing days at Southeast High School, Hunter was named Braden River’s first head football coach in March 2005.

He resigned as coach in April, and a few months later he resigned his position as a physical education teacher at the school.

Police Seeking Alleged DUI Killer, Asking for Your Help

Two warrants have been issued for the arrest of a Florida man accused of causing a horrific accident in Daytona Beach in October that left one person dead and another without a leg, a newspaper is reporting.

Lamar Preston Elton, 47, faces these charges: DUI causing the death of a human and DUI causing serious bodily injury to another, according to the Daytona Beach News Journal.

He is accused of crashing his pickup into the back of a minivan with six people, including a driver who lives in England and owns a house in Daytona Beach.

Fluker, who had a blood alcohol level of 0.11, according to police, also plowed his pickup into Terrell and biker Phillip Taylor. The legal definition of drunken driving is 0.08.

Florida Lawmakers Consider Bill to Make DUI Arrest Easier

As the time of the year when motorists have a reputation for being more likely to drive drunk passes, a pair of Northeast Florida lawmakers are considering a bill that would make it easier for police to make a DUI arrest without a warrant.

The proposal, offered in the House by Rep. Mike Weinstein, R-Jacksonville, and in the Senate by Sen. Steve Wise, R-Jacksonville, would allow officers to make an arrest for drunken driving without the warrant if they have “probable cause” to think a motorist was behind the wheel while intoxicated – whether they saw the person there or not.

With a few exceptions, police have to see a person commit a misdemeanor like most DUIs to make an arrest, even if they have witnesses.

An officer would not be able to arrest a person, for instance, if he or she was stopped at the guard station at a gated community and got out of the car after the guard called police, Weinstein said.

“The police can’t arrest the person for drunk en driving because he didn’t see the person behind the wheel,” said Weinstein, executive director of the state attorney’s office in Jacksonville.

The measure would also allow for warrantless arrests in the case of boating under the influence.

Similar proposals in the legislative session this past spring did not fare well. A House proposal never got a hearing, while its Senate counterpart passed one committee but later stalled. Some critics contend the law would allow police to make arrests based on flimsy evidence.

Sarasota judge to lead state DUI lab

Over the past few years, Sarasota County has become a trouble spot for prosecutors in DUI cases, partly because the local judges have issued rulings on complex issues involving alcohol breath tests.

That includes controversial rulings such as throwing out the alcohol breath-tests because of questions about the software inside the Intoxilyzer machines. Now, word of the reasons behind those legal decisions will spread a bit faster.

Sarasota County Judge Kimberly Carlton Bonner will spend the next three years leading the DUI Adjudication Lab,  which educates the state’s judges about DUI cases.

That includes an intensive week-long course to help new and experienced judges with all issues related to traffic DUI case, and it took place last week for the first time in Sarasota County.

Issues discussed were traffic stops, search and seizure, breathalyzer testing, jury selection, court costs, sentencing. Judge Bonner has been a frequent lecturer at the Florida New Judges College and the Florida County Judges Conference.
